1. Acceptance of Terms

By accessing or using PixelHug (the “Service”), you agree to be legally bound by these Terms and Conditions (“Terms”).

You represent that you are at least 18 years old and legally capable of entering into this agreement.

2. Nature of Service; Section 230 Protection

PixelHug is an interactive computer service provider.

Users are solely responsible for all content they upload, submit, or generate.

To the fullest extent permitted under 47 U.S.C. § 230, PixelHug shall not be treated as the publisher or speaker of any user-submitted content.

PixelHug does not endorse, verify, or assume responsibility for user content.

3. User Responsibility and License

You are solely responsible for all uploaded or generated content (“User Content”).

By submitting User Content, you represent and warrant that:

  • You own or control all necessary rights.
  • The content complies with applicable laws.
  • The content does not infringe third-party rights.

You grant PixelHug a worldwide, non-exclusive, royalty-free license to host, store, process, modify, analyze, transmit, and generate derivative outputs solely for operating and improving the Service.

4. Prohibited Content

You may not upload or generate content that:

  • Is sexually explicit, pornographic, or lewd
  • Exploits or depicts minors in any unlawful manner
  • Is defamatory, threatening, abusive, or hateful
  • Violates intellectual property rights
  • Contains private or confidential information without authorization
  • Promotes illegal activity
  • Contains malware or harmful code

You may not upload any content that:

  • Is illegal under any applicable law
  • Violates regulations or court orders
  • Is fraudulent, deceptive, or misleading
  • Is otherwise harmful or inconsistent with the intended purpose of the Service

PixelHug reserves sole discretion to remove content and terminate accounts.

5. Payments; Chargeback Policy

All payments are final unless otherwise stated.

By submitting payment, you:

  • Authorize PixelHug and its payment processor to charge your payment method.
  • Agree not to initiate fraudulent chargebacks.
  • Agree to contact PixelHug first to resolve disputes.

Fraudulent chargebacks may result in account termination and collection actions.

6. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELHUG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • SECURITY

PIXELHUG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELHUG SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS
  • LOSS OF DATA
  • BUSINESS INTERRUPTION
  • REPUTATIONAL HARM
  • EMOTIONAL DISTRESS

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PIXELHUG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Time Limitation for Claims

Any claim must be filed within one (1) year after it arises or it is permanently barred.

9. Binding Arbitration; Class Action Waiver

PLEASE READ CAREFULLY.

Any dispute shall be resolved by binding arbitration conducted by the American Arbitration Association on an individual basis.

You waive:

  • The right to a jury trial
  • The right to participate in a class action

You may opt out of arbitration within thirty (30) days of first use by written notice sent to: dluxx44@yahoo.com

10. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any matter not subject to arbitration shall be brought exclusively in the state or federal courts located in Texas.

You consent to jurisdiction in Texas.

11. Export Compliance

You agree not to use the Service in violation of U.S. export control or sanctions laws.

12. Force Majeure

PixelHug is not liable for delays or failures caused by events beyond its reasonable control.

13. Indemnification

You agree to indemnify and hold harmless PixelHug from any claims arising from:

  • Your User Content
  • Your violation of these Terms
  • Your misuse of the Service

14. Survival

Sections relating to license, indemnification, limitation of liability, arbitration, governing law, and payment obligations survive termination.

15. Changes to Terms

PixelHug may update these Terms at any time. Continued use constitutes acceptance.
